How the Freedom to Contract Protects Insurability

interesting and worth a read for
all Americans who are seeking real solutions to the problems we face with regard to the Health Care issue.
and no, the answer is not to give government even more power and control over our Health Freedom.
let us think outside the partisan box, in which we are being indoctrinated to be confined.

In response to this post, a friend wrote:

Bernard -- It sounds like you are against the bills that are being proposed by the Demo's right now. But if you are against them, let me ask you this:

What is the solution to the many uninsured people that are currently out there? Take the guy has no insurance. He has a catastrophic illness or injury. He requires a lot of medical care. He can't pay the bill. The hospital, the ambulance company, and the doctor all have to write off his bill. These costs don't just go away. They get passed on to people like me who have health insurance. This raises my annual premium. It's money out of my pocket.

If you are against the current proposals that fix this by forcing everyone to be insured, how do you propose we fix this problem?

Thanks.

i thought my friend had some very good questions and wanted to share this with all my friends.

i truly don't have all the answers to all these problems -- all i ever really wanted to be was a musician, and somehow i managed to wind up being overly impassioned for standing up and speaking out for liberty. 8-)
i'm still a babe with training wheels on with regard to the philosophies of liberty. thus, when i speak out against a course of action which is at enmity with liberty, it doesn't mean i know how to fix the problem, it just means that i see a problem and i feel urged to sound some kind of tyranny alarm! ;-)
it's kind of parallel to when i have a car problem. i might hear an odd noise, or feel that something is broken or breaking, which if not addressed will cause my car to stop working. i don't know how to fix the problem, but i just know there is a problem which needs to be fixed before i break down and become stranded somewhere.
the various hurdles we face as a nation are not always easy ones to stride. also, in the years of my involvement in liberty activism, i have learned that governing a people is no easy task. often, we must individually focus, or specialize, in a more narrow area of activism. if we all do likewise, we can more effectively and efficiently work together in our chosen avenues for advancing liberty.
personally, i have been primarily focusing on the matter of the lack of government accountability, the reluctance of SCOTUS in ruling on a definition of the "Accountability Clause" (last 10 words of the First Amendment), and the upcoming Continental Congress 2009, for which i am now considering candidacy as a NC delegate.
i personally feel that IF the "American" Federal Government will not be held to its Constitutional limitations and therefore refuses to obey the law of the land, then everything is moot. (i quote "American" because i no longer believe this is still the country of "America" for the very reasons i cite.)
therefore, it will not matter what legislation is passed, for what good are laws if they are not obeyed? how can this "America" if its government refuses to obey the the rule of law, and rather adopt a policy and MO of "rule of whim"?
i can say that it is quite evident through our recent history that the more We the People allow the government to get involved in areas it has no purpose and no jurisdiction, the more each of those areas get broken and corrupted. the Health Care system is no exception to this rule of thumb.
therefore, my general answer for solving such problems is to get government out of all markets outside of its proper function and within its jurisdiction and legal Constitutional limitations -- this is the only way in which a "free market" can thrive. one cannot have a "free market" and simultaneously have government intervention & "regulation" of the said market.
i only thus far skimmed over this article i sent out and posted on my blog. what i read was enough for me to realize that the article is noteworthy regarding the greater issue of Health Freedom.
it seems to stand to reason, that back when the government was not in the business of Health Care, it was affordable. if you are in your 40's or older, do you ever recall your parents being worried over medical bills? i don't! why? because it wasn't an issue, and coincidentally, the government was not so involved in the market of health care and medicine.
but again, this issue is much larger than merely addressing the problems in our current "Health Care System". besides government bureaucracy negatively affecting the prices of health care & medicine, i question:
• why the FDA approves poisons for our foods & medicines;
• why various natural drugs and remedies are made "illegal" when they have been proven for millennia to have legitimate medical uses;
• why alternative treatment centers for willing patients having no hope for cure have been run out of "America";
• why we are not addressing the fascism within our corrupt system, which has married BIG PHARMA with BIG GOVERNMENT.
further, in addressing any issue where money is one of the major hurdles, we also must look at deficit spending, and for that matter, 100% fiat currency created by a fractional banking system which has become corrupted to the point of insanity over the last century. we simply cannot expect things to be affordable when we have allowed the USD to become entirely worthless. how much longer before our economic condition becomes identical to that of Zimbabwe?
one of the primary fundamental issues regarding the health care debacle, is the revelation which many Americans have apparently not yet realized: providing health care is not a right -- individuals do not have an entitlement to health care. this deception has pulled the wool over the eyes of so many Americans.
we have no more entitlement to government provided health care than we do for government provided food, shelter, or clothing. to live in a free society, We the People have to provide for ourselves!
now, if We the People have grown tired of providing for ourselves, and we would collectively rather have a complete Nanny State, where the government provides everything for us, then that is up to US.
and that is exactly where "America" has been headed for over half its life -- probably since the 14th Amendment was ratified at the close of the Civil War, but certainly since 1913, when the Federal Reserve and the Income Tax was instituted, snowballing into an even deeper pit of authoritarian deception by the 30's with the so called, "New Deal".
"America" will reap exactly what it has sown -- we will get what is coming to us as we continue to dispense with nearly every single aspect of LIBERTY we still have... and this particular dispensation is a BIG ONE, as we are on the brink of giving up our last claims over our unalienable right to Health Freedom -- that's Health Freedom, NOT Health Entitlement.
when an individual is no longer allowed to have control over his own health and well being, that individual is simply no longer a free man... or woman, wherever applicable! ;-)
in liberty,

How the Freedom to Contract Protects Insurability

Paul Hsieh

http://snipr.com/rr76w

In a free market, profit-seeking businessmen would likely sell insurance coverage to individuals with preexisting conditions for an appropriate price, just as they would seek to meet substantial demand for any service if profitable. However, in the unlikely event that some individuals sought to purchase a policy that covered preexisting conditions, and no insurer would sell them such a policy, they would still have a viable alternative. They would be free to form their own risk pool with other like-minded individuals willing to share those risks. They would be free to create their own insurance company.

In fact, many Americans have already formed private pools in which members voluntarily share each other's health-care costs. For instance, more than 100,000 American Christians are members of "health-care sharing ministries"—arrangements whereby members pay a monthly fee to the ministries, which in turn distribute that money to other members facing expensive medical bills. Such groups typically accept members who meet certain religious and lifestyle requirements regardless of preexisting medical conditions.

Unfortunately, these health-care sharing ministries currently cannot guarantee payments to their members, because the government would then treat them as insurance companies5 and subject them to myriad onerous state and federal regulations that specify what prices they may charge, what benefits they must offer, and which customers they must accept.6 The only thing preventing individuals from creating their own contractually binding risk pools today is the government...

Officer Does Not Like anti-Obama Poster: "It ain't [America] no more, OK?"

http://www.youtube.com/watch?v=hIKPKjl0-pg

this is a very telling example by an authoritarian police officer who apparently has no idea about Constitutionally limited government, nor unalienable individual rights, which supports my theory of recent years: we're not in "America" any more!

for years now, i've been asking for someone to please explain to me why anyone would think we are living under an "American" government:

• does the "American" government obey the law?

• does "America" remain a Constitutionally limited government, accountable to the rule of law?

• is a "free" country defined by the flag it flies?

• should We the People adopt a philosophy of blind nationalism, obeying governing authorities even when they disobey the law of the land?

• if "America" was taken over by enemies domestic (a legitimate possibility according to the Constitution), how would We the People recognize it?

this video is one more proof of the mindset adopted by a large percentage of contemporary governing authoritarians in power in this country we still call "America".

i continue to advocate we educate ourselves about the philosophy of liberty and encourage our fellow Americans to do likewise, also informing everyone about the We the People Foundation & Congress, and especially governing authorities about the Oath Keepers.

The Left-Right Political Paradigm Deception

YUP! the article, "Glenn Beck's 9/12 Project; Selling the False Left/Right Paradigm" largely encapsulates, in at least one particular area, the sort of the perspective i've had for quite a while on the media & globalist government in general.
i'm not entirely convinced one way or the other about Glenn Beck. thus far, i can no further trust his allegiance to liberty any more than any other media personality. for the time being, i will continue to give him the benefit of doubt -- that he really might be coming around to embrace the philosophy of liberty. however, i cannot help to think that they are all merely playing their part in the left-right political paradigm deception, while their real agenda has more to do with increasing their bank accounts.
i find it somewhat ironic that various commenters to this article suggest supporting Cindy Sheehan & Jeremy Scahill. in doing so, they are exemplifying the very point that the article makes -- the globalist agenda is to divide, desiring Americans to flock to one of two sides:
1. conservative-fascism
2. liberal-socialism
running away from the radical war agenda of the fascists in order to flock to the radical anti-war agenda of the socialists, whose primary rallying war cry is "PEACE" is exactly what the authoritarian bastards want! (as if there was any kind of possibility for real peace among humankind - what folly! 8-)
in doing so, the principles of liberty and rule of law are entirely bypassed: there is no talk of Constitutionally declared wars -- a legitimate and proper role of federal government -- just WAR or NO WAR with no other options in between!
and this is just ONE issue, designed to attract the focus of those people who fall for the trap of a 'single issue prime directive', so that they are distracted from other issues wherein liberty is being trampled upon.
if we Americans who desire to maximize individual liberty while minimizing the power and scope of the State are going to have any real chance of seeing our agenda being advanced in our lifetime, we need to be savvy and see through the left-right political paradigm deception, reveal it for what it is to our fellow Americans, and then come up with an appropriate plan involving peaceful and civil revolution.
my continued suggestion is to stop placing so much emphasis upon the ballot box, which is as broken as all three branches of federal government. rather, we should continue to learn more about the philosophy of liberty and encourage others to do likewise.
i personally advocate considering the agenda of two particular liberty activist groups:
We the People Foundation & Congress @ GiveMeLiberty.org
OathKeepers @ OathKeepers.org

Don't recycle those (greasy) pizza boxes!

thanks for the info, Lance-a-lot! ;-)
i'm a serious advocate of recycling that works!
i use reusable canvass bags for shopping because i think it works (contrary to some frivolous reports about that). i try and only purchase tomato sauces in Ball (or similar) jars so as to use them as drinking glasses, or for canning (of course, i don't personally can, but many others do).
i have been trying to get my Diesel SAV (Suburban Assault Vehicle ;-) converted over to run waste veggie oil, but i'm having trouble getting my mechanic to finish the procedure. one day i hope i can finally do with my big'ol truck what i had planned on doing from the onset! 8-)
my personal take on being a conservationist/environmentalist (i realize some disagree these are one in the same, and perhaps they are correct! ;-), is to minimize my personal footprint on this earth while i am here to walk upon it.
i am not in favor of petitioning the federal government to govern in this area, because frankly, most of what the federal government gets its hands into turns out to be largely inefficient, and in many cases, blatantly wasteful.
from what i gather based upon various stories i've heard from friends coming out of the military is that our federal government is one of the largest contributers to waste and pollution -- i can certainly believe that, if managing our failing economy as being any indication of its modus operandi! ;-)
... and let's face it: if the government was really concerned about improving the conditions of our environment, it would have re-legalized hemp by now, when hemp isn't even a drug! it is a renewable resource which is good for the ground in which it grows fast! i won't go on about the myriad of uses for hemp and the good this God-given plant is for US, because frankly, it's bloody obvious to anyone with a brain! 8-)
the fact is for anyone who has not thought about this all that much, government is not helping to make our earth greener, but it is doing just the opposite in keeping hemp illegal. that would be the first step toward a greener "America", but apparently this "new" administration is no different from the last in this way as well as so many others.
regardless of the hurdles we face in the area of conservation of natural resources due to an un-libertarian government, i'd like to see locals (people within their communities) strive to improve the methods of recycling, and better yet, reuse of natural resources, without the necessity for getting government involved in areas it really has no business, unless someone is polluting someone else's property, water supplies, the air we breathe, etc.
here is my reply to the pizza box article:
i generally inspect used pizza boxes prior to throwing them into my recycling and make a call. if they are not that bad, i put them outside face up to get rained on an cleaned. usually, that takes care of the problem, as far as i can tell. but regarding the cost of recycling, i have been under the presumption, based on various studies in the past, that most recycling doesn't work very well anyway. from what i understand, ONLY aluminum is worth recycling via the current process and most all other forms (glass, paper, plastic) operate in the negative cost, and the processes used are actually bad for the environment (sort of like "green cars" having expensive batteries which need to be replaced every few years and are bad for the environment). ALSO, that much of the recycled material actually just winds up in the land fills. i've just been going along with it for years living in a house with 9 people, but feeling like i'm not really helping in doing so, and merely just "following the law". is this still true, or is there some new and improved recycling method that actually works well? i would not be surprised in the least, for nearly everything the government becomes involved in doesn't work!

Biased "Liberal" & "Conservative" Media

with all the biased comments thrown around against "biased conservative media" by the "liberals", this is certainly noteworthy.

this underlines the point i have been striving to make in blog posts like yesterday's, “Which Political Party Will Fix America?”:

both the RED & BLUE political camps have been hijacked by tyrannical authoritarians -- RED generally seems to lean fascist & BLUE generally seems to lean socialist. BOTH camps, exemplified by their very actions throughout the past Century of American history, are enemies to liberty.
in this particular case, MSNBC is caught blue handed in a blatantly obvious crafted deception, designed for no other reason to instigate racial tension, giving the impression that there are a bunch of "white people" showing up to Obama events.
the majority of Americans who have been brainwashed into believing the BLUE socialist-authoritarian party is actually a good thing for this country, will go away from watching this broadcast being confirmed in their deceptive belief that all those who are standing up for liberty against the fools running "America" into the ground are merely a bunch of white racists.
of course, the same exact thing occurs to the brainwashed RED fascist-authoritarian party supporters as a result of their preferred biased media source as well.
however, i don't think i have personally witnessed from any biased mainstream news network such a blatant attempt of deception, going through great pains in editing a video with the sole purpose of hiding the truth of the matter: that the guy with the assault rifle in the audience at the Obama event is BLACK!
i suggest to Americans of both camps that they turn OFF their boob-tube biased and deceptive news media sources, and seek out true news via the internet.

Media Bias Proof: MSNBC Turns Black People Into White People
Perhaps the headline above should red MSNBC turns blacks and whites against each other. In the clip below MSNBC reports on the gun carrying "racists" at Obama's town hall meetings. The footage they show of the man carrying the rifle does not reveal the man's face nor skin color. The man is black. The reason they choose these camera angles becomes obvious as the report unfolds. Revealing the man's race would not fit their version of the story. They'd look idiotic if they talked about all these "white people" carrying guns at Obama events if the one they showed was actually black. As it turns out they look not only idiotic but extremely biased.

Which Political Party Will Fix America?

you know i cannot resist stepping up on my soapbox for a moment to comment when i receive emails like this one i received today called "Our Social Security Eye Opener," which suggests that various economic evils America continues to face originated only in Democratic leadership.
yes, i'm mostly certain the data regarding the Social Security system fiasco being attributed to the Democratic Party is largely true. however, the SS system is not the only ill-conceived, ill-administered, and Constitutionally ill-legal government ponzi scheme enacted over the last Century or so.
but let me get the point of the email straight... so, all i have to do is vote "Republican" from now on and the Federal, State, & local governments will stop transgressing the Unalienable Rights of the Individual, the Constitution (Law of the Land), and actually allow for a free market to exist and liberty to thrive? really?!? ;-)
let me see... who was President when the first "Income Tax" was passed (Revenue Act of 1861) -- perhaps the most unethical and immoral tax known to man which deprives the individual of his unalienable right to privacy?
... oh, it was Abraham Lincoln, a REPUBLICAN! 8-)
and who was President when the Sixteenth Amendment was ratified on Feb 3, 1913, locking in place this evil new tax system which would grow over the Century into a 9+ Million word tax code of deception?
... oh, it was William Taft, a REPUBLICAN! 8-)
and shall we mention the myriad of Constitutional transgressions of another more recent corrupt REPUBLICAN Presidential administration, known to many as just "W"?
let's face the TRUTH: authoritarian tyrants really don't care which partisan letter, "D" or "R", resides next to their names. authoritarian tyrants merely desire power & wealth.
the large majority of Americans since the American Revolution are continuously deceived into continuing down the same old path of destruction, over and over again. We the People continue to elect the same types of people who belong to secret societies, and hob knob with a gang of elitist globalist who only benefit socialist and/or fascist agendas.
if you haven't yet done so, first watch "I.O.U.S.A." (the movie), and then if you dare, watch "The Obama Deception", by Alex Jones (horrible and inaccurate title, but great eye opening movie).
if We the People really want to do something to turn the tide of the tyrannical War on Liberty, besides dispensing with partisan politics and advancing liberty minded candidates, we need to stop looking toward a political party to fix America.
it would be most savvy to continue educating oneself in regards to the philosophy of liberty and encouraging others to do likewise.
the liberty activism groups i currently believe are most paramount to the never ending fight for liberty are: We The People & Oath Keepers, both of which are taking a different tack than the typical partisan political approach.

Subject: Fw: OUR SOCIAL SECURITY Eye Opener

I USED TO LAUGH WHEN MY FATHER, DEMOCRAT, TOLD ME, “SON, IT MAY BE SOCIAL BUT IT IS NOT SECURITY.” THAT WAS WAY BACK IN THE LATE 40”S, SOUNDED FUNNY, GOOD FOR A LAUGH. NOT NOW!!!

MY FATHER, WAS A PASSENGER CONDUCTOR ON THE NEW YORK CENTRAL RAILROAD. BACK IN THE 50’S CONGRESS, MOSTLY DEMOCRATS, VOTED TO TAKE OVER THE RAILROAD RETIREMENT FUND. WHICH THEY DID. SHORTLY AFTER THIS TAKE OVER MY FATHER BECAME A REGISTERED REPUBLICAN.

Our Social Security

Franklin Delano Roosevelt (Terms of Office March 4, 1933, to April 12, 1945), a Democrat, introduced the Social Security (FICA) Program.. He Promised:

1.) That participation in the Program would be Completely voluntary,

2.) That the participants would only have to pay 1% of the first $1,400 of their annual Incomes into the Program,

3.) That the money the participants elected to put Into the Program would be deductible from Their income for tax purposes each year,

4.) That the money the participants put into the Independent ‘Trust Fund’ rather than into the General operating fund, and therefore, would Only be used to fund the Social Security Retirement Program, and no other Government program, and

5.) That the annuity payments to the retirees would never be taxed as income.

Since many of us have paid into FICA for years and are now receiving a Social Security check every month -- and then finding that we are getting taxedon 85% of the money we paid to the Federal government to ‘Put Away’ -- you may be interested in the following:

Question: Which Political Party took Social Security from the Independent ‘Trust Fund’ and put it into the General Fund so that Congress could spend it?

Answer: It was Lyndon B. Johnson (Democrat, Term of Office: November 22, 1963 to January 20, 1969) and the Democratically Controlled House and Senate.

Question: Which Political Party eliminated the income tax Deduction for Social Security (FICA) withholding?

Answer: The Democratic Party.

Question: Which Political Party started taxing Social Security annuities?

Answer: The Democratic Party, with Albert Arnold Gore, Jr. (Al Gore) [Vice President Term of Office: January 10, 1993 to January 20, 2001] casting the ‘tie-breaking’ deciding vote as President of the Senate, while he was Vice President of the US.

AND MY FAVORITE:

Question: Which Political Party decided to start giving Annuity payments to immigrants?

Answer: That’s right! JAMES (JIMMY) EARL CARTER, JR. (DEMOCRAT, TERM OF OFFICE: JANUARY 20, 1977 TO JANUARY 20, 1981 AND THE DEMOCRATIC PARTY. IMMIGRANTS MOVED INTO THIS COUNTRY, AND AT AGE 65, BEGAN TO RECEIVE SOCIAL SECURITY PAYMENTS: THE DEMOCRATIC PARTY GAVE THESE PAYMENTS TO THEM, EVEN THOUGH THEY NEVER PAID A DIME INTO IT!

Then, after violating the original contract (FICA), the Democrats turn around and tell you that the Republicans want to take your Social Security away! And the worst part about it is uninformed citizens believe it!

If enough people receive this, maybe a seed of Awareness will be planted and maybe changes WILL evolve! Maybe not, some Democrats are awfully sure of what isn’t so. But it’s worth a try. How many people can YOU send this to? Actions speak louder than bumper stickers. AND CONGRESS GIVES THEMSELVES 100% RETIREMENT FOR ONLY SERVING ONE TERM!!!
